Enfrenta 13 años de prisión por agredir sexualmente a su sobrina con discapacidad y dejarla embarazada

The Prosecutor’s Office is requesting a sentence of thirteen and a half years in prison for a defendant accused of sexually assaulting his niece, who was under 14 at the time and has a 76 percent mental disability, repeatedly until she became pregnant.

According to the public prosecutor’s statement, when the minor visited her uncle’s house, the accused «took advantage of moments when they were alone to compel her to have sexual relations with him.»

The statement adds that the man touched and penetrated her, while the girl «tried unsuccessfully to break free,» and that there were «multiple» encounters, «without being able to specify the exact number.»

As a result of these acts, the minor became pregnant and gave birth to a girl when she was 15 years old.

The Prosecutor’s Office classifies the events as a continued crime of sexual assault against a minor under sixteen, deserving thirteen and a half years in prison, fifteen years of distance and prohibition of communication with the girl, ten years of deprivation of parental authority over the common daughter, twenty years of disqualification for working with minors, and ten years of supervised release after leaving prison.

In terms of civil liability, the public prosecutor requests that the accused compensate the young woman with 50,000 euros for the damages caused.

Additionally, it asks for the payment of a pension for the minor born between them.

The Third Section of the Provincial Court will judge this case on Monday, May 12, at 10:00 a.m., as reported by the Higher Court of Justice of Cantabria.

DRUG TRAFFICKING

In addition to this trial, another trial will also take place at 12:00 p.m., involving two defendants accused of drug trafficking and endangering road safety by carrying narcotics while driving through Barreda, Torrelavega.

The Prosecutor’s Office’s indictment states that the driver did not have a valid driver’s license due to losing all points, and when the National Police intercepted him, he was carrying a package of MDMA, thirteen packages of cocaine, and 1,040 euros in a fanny pack from drug sales.

Meanwhile, the second accused had cannabis resin, amphetamines, cocaine, alprazolam, clonazepam, and diazepam in his possession, and he carried four fake prescriptions for medications that he had prepared from an original prescription.

According to the forensic medical reports, the first individual has a disorder related to alcohol and cocaine, while the second has a diagnosis compatible with a mental and behavioral disorder due to the consumption of psychoactive substances.

Therefore, the public prosecutor considers that both cases involve the mitigating circumstance of criminal responsibility due to drug addiction.

The requested sentence for the driver amounts to three and a half years in prison and a fine of 4,700 euros, while for the passenger, the Prosecutor’s Office requests another five years in prison and a fine of 3,400 euros.
