Hombre acepta trece años y medio de cárcel por agredir y dejar embarazada a su sobrina: «Estoy arrepentido»
The accused of sexually assaulting his niece, who was under 14 years old at the time and impregnated her, has admitted to the crimes and pleaded guilty in the trial against him, held on Monday at the Provincial Court of Cantabria. He has agreed to the sentence of thirteen and a half years in prison requested by the prosecutor and the private prosecution.
«I am very sorry. I am repentant,» the man expressed in his final statement at the oral hearing, where he was not questioned by the parties as he admitted to the events and aligned with the prosecution’s written submissions and requests.
During the trial, the victim’s statement from the investigative phase was played, in which she, with a 76 percent mental disability, explained the touching and abuses and stated that she did not want them to happen.
«I was nervous. I didn’t understand what was happening,» she said in the video, mentioning that she cried because she wanted to leave the scene but he wouldn’t let her go. She also recounted how the accused told her not to disclose what was happening between them and threatened her with consequences if she did. However, she decided to speak up and now feels more at peace.
In the playback, the victim detailed the touching, «everywhere» over and under the clothes, as well as the penetrations and her attempts to resist because she did not like or want the encounters, which occurred on multiple occasions and at different times and places.
According to the prosecutor’s statement, the abuses occurred when the girl visited her uncle’s house. The accused took advantage of moments when they were alone to compel her to have sexual relations with him.
The prosecution described the man’s actions as multiple instances of touching and penetration while the victim tried unsuccessfully to free herself. As a result of these acts, she became pregnant and gave birth to a girl at the age of 15.
Regarding the crimes and penalties, the public prosecution, having finalized its provisional conclusions, classified the events as a continuous sexual assault on a minor under sixteen years old, deserving thirteen and a half years in prison, a fifteen-year restraining order and no contact with the girl, ten years of deprivation of parental rights over the common daughter, twenty years of disqualification to work with minors, and ten years of supervised release after prison.
In terms of civil liability, the accused is requested to compensate the young woman with 50,000 euros for the damages caused. Additionally, a pension for the child born between them and the payment of legal costs are also requested.
The prosecutor’s requests align with those of the private prosecution lawyer, with the defense attorney also in agreement.
After the evidence and final conclusions, the prosecutor urged the court of the Third Section of the Provincial Court of Cantabria to issue a guilty verdict as the accused has admitted to the crimes and accepted the written submissions and penalties.
Furthermore, it was emphasized that the accused acknowledged in court that he was aware of the girl’s age and disability, making her unable to consent to the sexual relations that continued until she became pregnant. DNA testing indicated that he is the baby’s father with a 99.99 percent certainty.
The private prosecution lawyer argued that the sexual relations were between an adult with full faculties and a very vulnerable individual with special characteristics, exploiting the latter’s vulnerability.
Lastly, the defense lawyer highlighted that her client acknowledged the facts and agreed with the penalties requested by the prosecution.
The trial has concluded and awaits a sentencing decision.
