La fiscal dice que la víctima de Liaño «firmó su sentencia de muerte» al llamar a la Guardia Civil y defensa solo ve «humo»

The prosecutor in the double murder case of Liaño, against the accused of murdering in December 2021 his partner and their eleven-month-old daughter, believes that the man «clearly intended» to kill them when he returned to the home from which he had been evicted for violating the restraining order he had against them, because he «could not bear» that the mother had «chosen» the child and he would be left «out on the street.»

Therefore, the woman «signed her death sentence» when she called the Civil Guard to have José R. kicked out of the house – he was released instead of arrested and now faces life imprisonment with possibility of parole after 26 years in prison – as explained by the public prosecutor in her final statement on Wednesday in the trial with a jury at the Provincial Court of Cantabria.

In the final stretch of the trial, the defense has concluded that there is «no conclusive evidence» against their client, only «indications,» such as the messages – text and voice – that he had sent to his partner for months, including threats of death and insults and expressions of hatred and disdain towards the baby, which, although «terrible,» are considered by this lawyer as «smoke bombs» because «there is nothing more.»

The prosecutor has explained to the members of the court – who will have to deliberate on the actionable facts included in the verdict from Thursday onwards – that at a certain point in the relationship, the victim had to choose between «continuing to suffer» with her partner or «protecting the little one she loved so much.»

She chose the latter, despite the ongoing threats and insults after the resumption of the relationship and despite the prohibition of approaching them due to a violent episode a month and a half before the double murder. And when she alerted the authorities to report the violation of the order, she «signed her death sentence.»

Furthermore, even though the forensic experts could not determine who died first – they established the time of death between three in the afternoon and nine at night on December 16, 2021, a day before the bodies were found in the family home in Liaño de Villaescusa – the prosecutor is certain that José R., to inflict «greater suffering» on the woman, first attacked the child (who died of asphyxiation), causing the mother, who had six stab wounds, to «bleed to death while watching her daughter die,» who «did not even reach the age of one because her father killed her.»
